WMC v. Evers: Case Update
In WMC v. Evers, plaintiff Wisconsin Manufacturers and Commerce are suing to prevent the state from releasing information about businesses whose employees have had COVID-19, or through contact tracing, are believed to have been in contact with someone who had COVID-19. WMC was successful in convincing the court to issue a temporary restraining order, which has been in effect since October 1st. Currently, the case is scheduled for a motion to dismiss hearing on November 30, 2020.
Naturally, WMC has filed a brief in opposition to the motion to dismiss, which can be read in full below. Additionally, WMC’s position has been supported by two different amici. The first is made up of local Wisconsin business organizations, all of which are named in their brief, also included below. The other amici is the National Federation of Independent Business, the Wisconsin Restaurant Association, and the Restaurant Law Center. Their brief was completed by the Great Lakes Legal Foundation and can be found below.
